MINUTES-SPECIAL MEETING
SEPTEMBER 16, 2020
Mayor Knoke called the special meeting of the City Council to order at 6:00 p.m. at the City Hall. There was no advance notice given due to the unforeseen circumstances regarding a matter that required immediate attention by the Council.
Mayor Judith Knoke presided and City Clerk Kimberly Goossen recorded the proceedings. The following Councilmembers were present: Stan Krause, Shane Stutzman, Harlan Schrock. Phyllis Ryan, absent. A quorum being present and the meeting duly convened, the following proceedings were had and done.
As required by the Nebraska Open Meetings Act, Mayor Knoke announced that a copy of the Nebraska Open Meetings Act has been posted on the south door of the City Hall meeting room for all in attendance to review.
Motion was made by Schrock, seconded by Krause, to open the public hearing to receive comments relating to the proposed 2020-2021 budget. On roll call voting aye, Stutzman, Krause, Schrock. Ryan, absent. Nays none. Motion carried. Public hearing opened at 6:02 p.m.
Mayor Knoke announced that public comments would be received at this time. No comments were offered.
Discussion was held on the proposed budget for 2020-2021. Councilman Schrock stated that all department heads did a great job crunching numbers in putting the budget together.
Motion was made by Krause, seconded by Stutzman, to close the public hearing to receive comments relating to the property tax request for 2020-2021, and to receive comments relating to the proposed 2020-2021 budget. On roll call voting aye, Schrock, Stutzman, Krause. Ryan, absent. Nays none. Motion carried. Public hearing closed at 6:38 p.m.
Resolution No. 20-10 was introduced and read by Mayor Knoke.
RESOLUTION NO. 20-10
WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the Governing Body of the City of Friend passes by a majority vote a resolution or ordinance setting the tax request; and
WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; and
1. The 2020-2021 property tax request be set at $485,791.37 ($306,380.62 General Fund and $179,410.75 Bond Fund).
2. The total assessed value of property differs from last year’s total assessed value by 5%.
3. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property, would be $0.679403 per $100 of assessed value.
4. The City of Friend proposes to adopt a property tax request that will cause its tax rate to be $0.792791 per $100 of assessed value.
5. Based on the proposed property tax request and changes in other revenue, the total operating budget of $13,706,407.56 will exceed last year’s by 22%.
6. A copy of this resolution be certified and forwarded to the County Clerk on or before October 13, 2020.
Proposed Ordinance #20-768 was read by Mayor Knoke. Councilman Schrock moved that the statutory rule requiring reading on three different days be suspended. Councilman Stutzman seconded the motion to suspend the rules and upon roll call, voting on the motion was as follows: Members voting aye, Krause, Stutzman, Schrock. Ryan, absent. Members voting nay, none. The motion to suspend the rules was adopted by at least three-fourths of the Council and the statutory rule was declared suspended for consideration of the ordinance.
ORDINANCE NO. 20-768
AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL; TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF FRIEND, NEBRASKA:
Section 1.
That after complying with all procedures required by law, the budget presented and set forth in the budget statement is hereby approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2020 through September 30, 2021. All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the City of Friend. A copy of the budget document shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln, Nebraska, and to the County Clerk of Saline County, Nebraska, for use by the levying authority.
Section 2.
This ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.
Councilman Krause moved for final passage of Ordinance Number 20-768, which motion was seconded by Councilman Stutzman. On roll call voting aye, Schrock, Stutzman, Krause. Ryan, absent. Voting nay, none. The passage and adoption of said ordinance, having been concurred and by a majority of all Members of the City Council, Ordinance Number 20-768 was adopted this 16th day of September 2020.
No further business to come before the City Council, motion was made by Schrock, seconded by Stutzman, to adjourn the meeting. On roll call voting aye, Krause, Stutzman, Schrock. Ryan, absent. Motion carried. Meeting adjourned at 6:42 p.m.
